Course Description: The aim of this course is to provide a sound understanding of the procedure to be followed when work to which the Party Wall etc. Act applies are to be undertaken, in serving of notice on neighbouring owners and the subsequent appointment of surveyors should a dispute arise therefrom. However, the course is not designed to give an in depth knowledge of the Act such as a party wall surveyor would need to know in order to act competently.
Topics include:
- Defining Party Fence Walls, Party Walls and Party Structures
- An overview of the works to which the Act applies:
- Section1 - New building on the line of junction
- Section 2 - Raising, repairing or replacing party walls/fence walls etc.
- Section 6 - Adjacent excavation
- Notices – content, service and effect
- The appointment and function of party wall surveyors, awards and appeals
- Ownership in terms of the Act and why it is important
- Unnecessary inconvenience - section 7(1); Loss or damage – section 7(2)
- Access to neighbouring land - section 8
- Selected aspects of sections 11 and 12
- Recovery of unpaid fees
There will be a Q&A session at the end of the day, time permitting
